Washington The National Association for Health Care's Center for Health Care Law plans to file a class-action lawsuit against Medicare's recoupment of overpayments related to the interim payment system.

The center claims the law allows waiving recoupment when the provider is without fault. At press time, CHCL was in the process of selecting plaintiffs to ensure geographical balance and to strengthen the case, said Bill Dombi, a lawyer with CHCL. The suit was expected to be filed in March.-K.G.
